"HAZARDOUS MATERIAL EMERGENCY PLANNING & RESPONSE ACT"
Act of 1990, P.L. 639, No. 165 35
An Act Establishing a Statewide hazardous material safety program; creating the Hazardous Material Response Fund; providing for the creation of Hazardous Material Emergency Response Accounts in each county; further providing for the powers and duties of the Pennsylvania Emergency Management Agency, of the Pennsylvania Emergency Management Council and of the counties and local governments; imposing obligations on certain handlers of hazardous materials; and imposing penalties.
After the act was passed, sample ordinances were distributed to fire chiefs and municipalities. All municipal elected officials were encouraged to enact local ordinances allowing the ability to recoup extra-ordinary expenses associated with an incident or disaster requiring specialized equipment, skills or materials. Please review this information with your local elected officials to insure that your station and municipality have an option to recoup extraordinary cost associated with a hazardous materials incident.
